A proper Estate Plan does more than just transfer your property to your designated beneficiaries after your death. It can also assist you and your family in the event you become incapacitated and are unable to handle your financial and/or medical affairs.

An Estate Plan may include different documents to accomplish your goals. At The Law Office of Tracie Martinez we focus on the individual needs and goals of each client, so that an Estate Plan can be customized. One size does not fit all. Our firm will take the time to listen to your unique situation to best address your assets and family situations.

An Estate Plan may be comprised of:

  • Will: Contains instructions as to what should be done with one's money and property after one's death, and nominate guardianship of minor children.

  • Trust: Revocable Trust, or Living Trust, is a legal document that is a substitute for the Probate Court for when your estate is administered.

  • Power of Attorney: Nominate an agent to act on your behalf for financial matters.

  • Advance Health Care Directive: Living Will or Medical Directive, specifies what actions should be taken for their health if they are no longer able to make decisions for themselves.

If you have an existing Estate Plan, our firm will review it with you to ensure it accomplishes the goals you have, and any relevant changes in the law. As life goes on, your goals or wishes may change, and you may need to amend your Estate Plan.
